Terms of Service

Welcome! The following are the terms of use that govern your use of the MY Bharat Platform.

Our Privacy Policy, and any other policies, rules or guidelines that may be applicable to particular offers or features on the Site are incorporated in these Terms. By visiting or using the Site, you expressly agree to these Terms, as updated from time to time.

NOTICE REGARDING FUTURE CHANGES TO TERMS:
We may make changes to these Terms at any time. Any changes we make will be effective immediately when we post a revised version of these Terms on the Site. The "Last Updated" date above will tell you when these Terms were last revised. By continuing to use this Site after that date, you agree to the changes.

1. ACCOUNT REGISTRATION

  1. You may browse the Site without registering for an account. However, you will be required to register for an account to participate in the activity under MY Bharat programme.
  2. Your account or mobile number is personal to you.
  3. You will be responsible for the confidentiality and use of credentials for all activities that are conducted through your account. We will not be liable for any harm caused owing to the disclosure of your credentials or use by anyone else.
  4. You may not use another user's account.
  5. You will immediately notify us in writing if you discover any unauthorized use of your account or other account-related security breaches. If we receive a complaint that your account violates someone else's rights, or violates our policies we may cancel or block your account.
  6. When you register on MY Bharat through NSSO, acceptance of these Terms of Use amounts to your consent for use of the identity information provided by you for the use of such identity information, by MY Bharat.

2. CODE OF CONDUCT

You agree that you will comply with all applicable laws, rules and regulations and that you will not:

  1. Restrict or inhibit any other person from using the Site.
  2. Use the Site for any unlawful purpose
  3. Post content or upload images that infringe or violate someone else's rights or otherwise violates the law.
  4. Express or imply that any statements you make are endorsed by us, without our prior written consent.
  5. Impersonate any person or entity, whether actual or fictitious.
  6. Engage in spamming or flooding.
  7. Harvest or collect information about Site users.
  8. Open multiple accounts for yourself or any other individual using multiple mobile numbers.

3. OWNERSHIP OF CONTENT AND GRANT OF CONDITIONAL LICENSE

The Site and all data, text, designs, pages, print screens, images, artwork, photographs, audio and video clips Ownership of Content and Grant of Conditional License, and HTML code, source code, or software that reside or are viewable or otherwise discoverable on the Site, and all appointments booked from the Site, (collectively, termed as the "Content") are owned by the Ministry of Youth and Sports or our authorised service providers. Ministry of Youth and Sports (MoYAS) owns a copyright and other intellectual property in the Site and Content. Content and features of the Site may be changed at any time.

The Portal mybharat.gov.in and associated services are maintained by Digital India Corporation as under guidance from Ministry of Youth Affairs and Sports (MoYAS), Government of India. MoYAS has the full ownership, and responsibility of all Website and User Data, Procedures, Processes and Protocols.

Material featured on this website may be reproduced free of charge. However, the material has to be reproduced accurately and not to be used in a derogatory manner or in a misleading context. Wherever the material is being published or issued to others, the source must be prominently acknowledged. However, the permission to reproduce this material shall not extend to any material which is identified as being copyright of a third party (user-submitted content). Authorization to reproduce such material must be obtained from the copyright holder concerned.

We grant you to view this Site and its Content as permitted by these Terms for non-commercial purposes only if, as a condition precedent, you agree that you will not:

  1. Submit any software or other materials that contain any viruses, worms, Trojan horses, defects, date bombs, time bombs or other items of a destructive nature.
  2. Manipulate identifiers, including by forging headers, in order to disguise the origin of any posting that you submit.
  3. Link to any portion of the Site other than the URL assigned to the home page of the Site.
  4. "Frame" or "mirror" any part of the Site
  5. Modify, adapt, sub-license, translate, sell, reverse engineer, decompile or disassemble any portion of the Site, or otherwise attempt to derive any source code or underlying ideas or algorithms of any part of the Content.
  6. Remove any copyright, trademark or other proprietary rights notices contained on the Site.
  7. Use any computer program, bot, robot, spider, offline reader, site search/retrieval application or other manual or automatic device, tool, or process to retrieve, index, data mine, or in any way reproduce or circumvent the security structure, navigational structure, or presentation of the Content or the Site, including with respect to any CAPTCHA displayed on the Site. Operators of public search engines may use spiders to copy materials from the Site for the sole purpose of and solely to the extent necessary for creating publicly available searchable indices of the materials, but not caches or archives of such materials. We may revoke this exception at any time and require the removal of archived materials gathered in the past.
  8. Use any automated software or computer system to search for or participate in activities including sending information from your computer to another computer where such software or system is active.
  9. Take any action that imposes or may impose (in our sole discretion) an unreasonable or disproportionately large load on our infrastructure.
  10. Access, reload, or refresh transactional events or schedule appointment pages, or make any other request to transactional servers, more than once during any three-second interval.
  11. Make more than 20 search requests on the Site in any 15 mins session duration.
  12. More than 1,000 requests of the Site (50 times crossing 20 search requests per 15 mins session) whether alone or with a group of individuals.
  13. Reproduce, modify, display, publicly perform, distribute or create derivative works of the Site or the Content.
  14. Reproduce or scan appointment slips in a format or medium different from that provided by the Site.
  15. Use the Site or Reproduce, modify, display, publicly perform, distribute or create derivative works of the Site or the Content.
  16. The Content in an attempt to, or in conjunction with, any device, program or service designed to circumvent any technological measure that effectively controls access to, or the rights in, the Site and/or Content in any way including, without limitation, by manual Decode, decrypt, modify, or reverse engineer appointment slip or underlying algorithms or barcodes used on or in production of tickets or the Site or automatic device or process, for any purpose.
  17. Use bot technology to search for activities through the Site; for the avoidance of doubt, this specifically prohibits you from using automated software on the Site, and prohibits you from circumventing any security measure, access control system, or other technological control or measure on the Site that is used to enforce 4 booking appointment schedule limits.

The registered and unregistered trademarks, logos, and service marks displayed on the Site are owned by us or our licensors. You may not use our trademarks, logos, and service marks in any way without our prior written permission.

4. LIMITATIONS OF MULTI-LINGUAL INTERFACE

Translations on the MY Bharat portal are prepared by third-party translators. While reasonable efforts are made to provide accurate translations, portions may be incorrect. Some files, and other items cannot be translated. In addition, some applications and/or services may not work as expected when translated due to language restrictions. We are working constantly to rectify any errors, omissions, or ambiguities in the translations provided on this portal.

5. LINKS

The Site contains links to other websites that may not be owned or operated by us. The fact that we may link to those websites does not indicate any approval or endorsement of those websites. We have no control over those websites. We are not responsible for the content of those websites, or the privacy practices of those websites. We strongly encourage you to become familiar with the terms of use and practices of any linked website. Your use of other websites is at your own risk and is subject to the terms of those websites. It is up to you to take precautions to ensure that whatever links you select or software you download (whether from the Site or other sites) is free of viruses, worms, Trojan horses, defects, date bombs, time bombs, and other items of a destructive nature.

6. VIOLATION OF THESE TERMS

We may investigate any violation of these Terms, including unauthorized use of the Site. We may provide law enforcement with information you provide to us related to your transactions to assist in any investigation or prosecution of you. We may take legal action if we feel that is appropriate. If we determine that you have violated these Terms or the law, or for any other related reason, we may block your account and will prevent you from accessing the Site at any time without any notice.

7. UTILIZATION OF MY Bharat APIs

Every Application Service Provider (ASP) that wishes to utilize the MY Bharat APIs/ No-code webpage integration, shall have to submit an undertaking that the ASP agrees to the following Terms of Service:

Consent

Any application (API/ No-code webpage integration Client) developed by ASPs that uses MY Bharat APIs to access and collect data from MY Bharat, should ensure that it cannot access and collect personal data except as provided in the guidance issued by the Ministry of Youth Affairs and Sports. Wherever personal data is collected, consent management will have to be undertaken as per the extant policy/ directions of the government issued in this regard as may be applicable. If any user does not consent to share their data, through the MY Bharat APIs/ No-code webpage integration, then it must be ensured that such users have other viable and alternate mechanisms by which they can avail of MY Bharat-related services through these applications.

API/ No-code webpage integration Limitations

API/ No-code webpage integration requests will have predefined limited usage policies that may limit the number of users that can be served, including other limitations, as deemed appropriate by MoYAS. Authorized organisations shall not circumvent or attempt to circumvent these limitations, and appropriate action in accordance with the law shall be taken in the instance of such circumvention or attempt to circumvent. If, for any reason an exception is desired, written consent from MoYAS’s or its service provider’s MY Bharat team is required.

Re-Distribution

Authorized organizations shall not re-distribute any data that they are able to access through the API/ No-code webpage integration and shall ensure that integration of all such data shall compulsorily be limited to the specific services provided by MY Bharat. Under no circumstances, shall an organisation use the data collected for any purposes other than the purposes specified herein, and as may be permitted by the government.

Compliance with Law, Third Party Rights, and Other Terms of Service

The authorized organizations will comply with all applicable laws, regulations, policies and third-party rights (including without limitation, any laws regarding the import or export of data or software, privacy, and local laws) established by the Government of India. These organizations will not use the APIs/ No-code webpage integration to encourage or promote illegal activity or violation of third-party rights including these “Terms of Service” with MY Bharat.

Correctness of Data provided by third-party systems

The ASPs collecting data from MY Bharat and displaying to users shall be solely responsible for the correctness of such data and any liability arising out of any data so provided shall completely rest with such third party. Any liabilities civil or criminal, arising out of any incorrect data shall solely lie with the concerned ASP.
